1. Description of Promotion

Welcome to the April Casino Sweepstakes promotion (the “Promotion”) where participants earn an entry tickets to a random prize drawing when they place a wager of at least Twenty-Five Dollars  ($25) on eligible casino games, placing a wager of at least Fifty Dollars ($50) on eligible table games or entering via the alternate method described in Section 4.

The Promotion is sponsored by TSG Interactive US services Limited (“Sponsor”).  The terms “you” or “your” mean the person to whom a Promotion Bonus (defined below) is issued to upon satisfaction of the official rules set forth in this Promotion.  Redemption of the Promotion is expressly conditioned upon acceptance of and compliance with all of these Promotion “Official Rules”.  Promotion participants may be required to sign paperwork issued by the Sponsor.

2. Promotion Period

The Promotion will run from 00:00 ET on April 3, 2023 until 23:59 EST on April 21, 2023. (the “Promotion Period”).

3. Eligibility

The Promotion is only open to individuals who are at least 21 years of age and are physically present in Michigan during the Promotion Period and otherwise comply with all eligibility requirements in order to have a TSG account (as defined below). Employees, officers and directors of the Sponsor, affiliates, cable/satellite affiliates, advertising and promotion agencies, retailers, distributors, and each of such employees’, officers’ and directors’ immediate family members and/or those living in the same household (whether legally related or not) of each are not eligible to participate in the Promotion. Employees of other sports wagering sites are not eligible to participate in the Promotion.

4. Action Required

There are two (2) methods of entry to receive an entry into the prize drawing, (each an “Entry”).

Wager Entry: Account holders must log in during the Promotion Period and opt into the Promotion. After opting-in, place real money wagers totalling at least Twenty-Five Dollars ($25) on eligible slot games or Fifty Dollars ($50) on eligible table games. Users need only opt in once during the Promotion Period.  There is no limit on the number of entries you may earn by submitting an eligible Wager Entry.

Alternative Method Entry: Alternatively, participants may enter this Promotion by sending a copy of a valid US photo ID along with your name, address, gender, age, email address, TSG username and favorite slot game to Sponsor at #1096 2230 Route 70 W STE 2, Cherry Hill, NJ 08002 (the “Alternate Method of Entry”). All Entries submitted via the Alternate Method of Entry must be submitted during the Promotion Period. Individuals must have a TSG Account (as defined below) to submit an Alternate Method of Entry. There is no limit to the number of Alternate Method Entries you submit.

All participants in this Promotion agree that he or she has reviewed and accepts these rules and the Sponsor’s Privacy Policy and Terms of Service. Each Participant agrees to abide by these Rules and the decisions of the Sponsor, which are final and binding in all respects.

5. Claiming Promotion Offer

Upon successfully submitting an Entry into the Promotion, participants will receive one (1) entry ticket to the random prize drawing taking place on April 24, 2023 (the “Drawing”) (and collectively the “Promotion Bonus”). The winners will be announced on April 25, 2023. The Drawing shall only be performed once.

If randomly selected to win a Prize (as highlighted below) Sponsor will contact, you via the email you used to submit your Entry within Seventy-Two (72) hours of the conclusion of the Drawing.  If any selected winners cannot be contacted successfully (notwithstanding agency’s or the operator’s attempts), the given prize award may be declared void at Sponsors discretion, consequent to which the prize shall not be allocated to any other participant.

There will be one thousand (1,000) Prizes awarded in total:

The Prize is non-transferable, with no cash redemptions, equivalents or substitutions except at Sponsor’s sole and absolute discretion. All Prize details not specified in these Official Rules will be determined in Sponsor’s sole and absolute discretion. Prize details and availability are subject to change and prize provider’s rules and restrictions, and in the event that Sponsor is unable to provide the winner with his or her Prize, the Sponsor may elect to provide the Winner(s) with the approximate value of such item in cash or award an alternate prize of comparable or greater value. The Prize is awarded “AS IS” and without warranty of any kind, express or implied (including, without limitation, any implied warranty of merchantability or fitness for a particular purpose). The approximate retail value (“ARV”) of the Prize is based on available information provided to Sponsor and the value of any prize awarded to a winner may be reported for tax purposes as required by law. The Winner(s) may be required to provide Sponsor with a valid social security number (if winner is residing in the U.S.) before the Prize will be awarded for tax reporting purposes. An IRS Form 1099 may be issued in the name of the Winner(s). Unclaimed Prize(s) will be forfeited. Prize(s), if legitimately claimed, will be awarded. The Sponsor is not responsible for and will not replace any lost, mutilated or stolen Prize(s) or any Prize that is undeliverable or does not reach a Winner because of an incorrect or changed address. If a Winner does not accept or use the entire Prize, the unaccepted or unused part of the Prize will be forfeited, and the Sponsor will have no further obligation with respect to that Prize or portion of the Prize. No more than the stated Prize(s) will be awarded. The Sponsor is not responsible for and Winner(s) will not receive the difference, in any, between the actual value of the Prize(s) at the time of award and the stated ARV in these Official Rules or in any sweepstakes-related correspondence or material.

6. Registration Procedures

To qualify for the Promotion, eligible individuals must have an active PokerStars Casino, PokerStars or FOX Bet account (“TSG Account”) and verify your identity in order to participate in the Promotion. Creating a TSG Account at www.starscasino.com is free. By submitting your information and creating a TSG Account, however, participants will be required to agree to the TSG Privacy Policy and Terms. If you do not agree to TSG’s Terms and Privacy Policy, you cannot create a TSG Account or participate in this Promotion.

7. Limitations on Participation

In addition to the eligibility requirements in Section 3, Sponsor reserves the right to refuse or otherwise restrict your eligibility to participate in any Promotion for any reason, in our sole discretion, including based on your wagering patterns or wagering history or if you failed to take advantage of any previous Promotion in good faith. This Promotion is void where prohibited by law. Limit of one (1) Prize per Promotional Period.

8. Wagering Requirements

See Section 4. The Promotion Bonus is not transferable and cannot be substituted except in the Sponsor’s sole discretion. Any wager placed prior to opting-in to the Promotion or after the expiration of the Promotion Period will not be deemed to fulfill the Wager Method requirements.  Separately, wagers placed using site credits or any bonus received from a separate Sponsor promotion will not be deemed eligible to fulfill the Wager Method requirements. 

The Promotion Bonus is not transferable and cannot be substituted except in the Sponsor’s sole discretion.  Casino Site Credit may only be used for wagering on your TSG Account. Notwithstanding the foregoing, the Promotion Bonus may be converted to cash by earning 2 redemption points for every $1 in Casino Site Credit awarded on any of Sponsor’s table and slot casino games, excluding live dealer table games. 11. Restrictions on Withdrawal

The Promotion Bonus/Prize is non-withdrawable, but any winnings therefrom is immediately withdrawable. Any unused portion of a casino bonus Prize will be automatically withdrawn from your TSG Account seven (7) days after being credited to your TSG Account. You may withdraw your deposited funds at any time.

12. Cancellation

Should you wish to cancel your participation in this Promotion at any time, please contact customer support at support@foxbet.com. Upon cancellation, you may withdraw any funds you have deposited into your account without restriction. However, any Promotion Bonus amount in your account may not be withdrawn.

14. Additional Terms

Administration:  The Sponsor expressly reserves the right to amend, suspend or terminate this Promotion at any time without prior notice or consent.  Administration of this Promotion is at the sole discretion of the Sponsor.  Sponsor reserves the right to restrict at any time any TSG Account holder from participating in this Promotion for any reason.  Any questions relating to eligibility, these Official Rules or any other questions concerning this Promotion will be resolved at the sole discretion of the Sponsor and its decisions will be final and binding with respect thereto.  No groups, clubs, corporations, companies, partnerships, or organizations may participate in this Promotion or reproduce or distribute any portion of these Official Rules to their members.

Release and Waiver of Liability:  By redeeming this Promotion, participants agree to release, defend, indemnify and hold harmless the Sponsor, the NHL Entities, its affiliates, gaming license partners, advertising and promotion agencies, directors, officers, employees, representatives and agents (the “Released Parties”) from and against any and all liability claims or actions of any kind whatsoever (however named or described) for injuries, death, damages or losses to persons and property which may be sustained in connection with: (i) your participation in the Promotion; and (ii) the receipt, use or misuse of the Promotion Bonus, or while preparing for, participating in, and/or traveling to any Promotion-related activity, including those damages caused by the Sponsor’s own negligence.  The Sponsor expressly disclaims any responsibility or liability for injury or loss to any person or property relating to the delivery and/or subsequent use or misuse of the Promotion Bonus.  In consideration of the Promotion Bonus, each individual hereby agrees and consents, without further authorization, compensation or remuneration of any kind, to the use of such individual’s name, photograph, likeness (including his/her voice), biographical information and statements concerning the Promotion, in any and all advertising, promotions and other publicity conducted by the Sponsor and its affiliates.

Governing Law:  All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules or the rights and obligations of participants and the Sponsor in connection with the Promotion will be governed by and construed in accordance with the internal laws of the State of New York, without giving effect to any choice of law or conflict of law rules or provisions that would cause the application of any other laws.

Dispute Resolution:  The parties each agree to finally settle all disputes only through arbitration; provided, however, the Sponsor shall be entitled to seek injunctive or equitable relief in the state and federal courts in New York County, New York and any other court with jurisdiction over the parties.  In arbitration, there is no judge or jury and review is limited.  The arbitrator’s decision and award is final and binding, with limited exceptions, and judgment on the award may be entered in any court with jurisdiction.  The parties agree that, except as set forth above, any claim, suit, action or proceeding arising out of or relating to this Promotion shall be resolved solely by binding arbitration before a sole arbitrator under the streamlined Arbitration Rules Procedures of JAMS Inc. (“JAMS”) or any successor to JAMS.  In the event JAMS is unwilling or unable to set a hearing date within fourteen (14) days of the filing of a “Demand for Arbitration”, then either party can elect to have the arbitration administered by the American Arbitration Association (“AAA”) or any other mutually agreeable arbitration administration service.  If an in-person hearing is required, then it will take place in New York, New York.  The federal or state law that applies to these Official Rules will also apply during the arbitration.  Disputes will be arbitrated only on an individual basis and will not be consolidated with any other proceedings that involve any claims or controversy of another party, including any class actions; provided, however, if for any reason any court or arbitrator holds that this restriction is unconscionable or unenforceable, then the agreement to arbitrate doesn’t apply and the dispute must be brought in a court of competent jurisdiction in New York County, New York.  The Sponsor agrees to pay the administrative and arbitrator’s fees in order to conduct the arbitration (but specifically excluding any travel or other costs of participant to attend the arbitration hearing). Either party may, notwithstanding this provision, bring qualifying claims in small claims court.

LIMITATION OF LIABILITY: TO THE FULLEST EXTENT PERMISSIBLE UNDER APPLICABLE LAW, NEITHER THE SPONSOR NOR ANY OTHER RELEASED PARTY SHALL BE RESPONSIBLE OR LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, ECONOMIC, EXEMPLARY, PUNITIVE OR OTHER DAMAGES UNDER ANY CONTRACT, NEGLIGENCE, STRICT LIABILITY OR OTHER THEORY ARISING OUT OF OR RELATING IN ANY WAY, DIRECTLY OR INDIRECTLY, TO REDEMPTION OF THE PROMOTION, EVEN IF FORESEEABLE OR EVEN IF THE SPONSOR HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

Miscellaneous:  No waiver of any of the provisions of these Official Rules shall be deemed or shall constitute a waiver of any other provisions hereof, nor shall waiver constitute a continuing waiver unless otherwise expressly provided.  If any provision of these Official Rules is found to be invalid or unenforceable by a court of competent jurisdiction, such provision shall be severed from the remainder of these Official Rules, which will otherwise remain in full force and effect.
